These Terms of Use ("Terms") govern your access to and use of the BaliRent website, applications, booking tools, customer support channels, communications, and related medical equipment rental services (collectively, the "Platform").
These Terms are a legally binding agreement between you ("User", "Customer", or "you") and BaliRent ("BaliRent", "we", "us", or "our"), an operating division of PT Medisfera Farmasi Group, located in Badung Regency, Bali, Indonesia.
By accessing or using the Platform, creating an inquiry, placing a booking, communicating through WhatsApp, or clicking to accept these Terms, you agree to be bound by these Terms, our Privacy Policy, and our Rental Agreement. If you do not agree, do not use the Platform.
1. Acceptance of Terms & Capacity
By utilizing our services, you certify that you are at least 18 years of age or possess the requisite legal capacity under applicable law to enter into binding agreements. If you are booking on behalf of a family member, patient, or tour group, you represent that you have the requisite authority to bind such individuals to these Terms.
2. Platform Services & Booking Reservations
BaliRent facilitates the reservation, delivery, setup, and retrieval of durable medical equipment and mobility aids across Bali, Indonesia. When submitting a reservation or inquiry:
- You agree to provide accurate, current, and complete information regarding your legal identity, active WhatsApp number, and delivery accommodation details (hotel, resort, or private villa address).
- We reserve the right to verify customer identity or decline reservations where safety, fraudulent card use, or inaccurate accommodation details are identified.
3. Medical Disclaimer & Urgent Care
Important Notice: BaliRent is an authorized equipment supplier and rental provider. We do not provide medical diagnosis, medical treatment, emergency triage, or individualized physician prescriptions. All durable medical equipment (including wheelchairs, patient mobility aids, oxygen concentrators, and respiratory devices) is supplied for patient comfort and travel convenience under the supervision and guidance of your treating physician.
In the event of an acute medical emergency while visiting Bali, please contact local emergency services immediately by dialing 112 or contact an accredited international hospital clinic (e.g., BIMC Hospital Bali or Siloam Hospital).
4. Equipment Provision & Permitted Use
All rental equipment provided by BaliRent undergoes rigorous inspection and hospital-grade sanitization prior to dispatch. Use of the equipment is strictly governed by our Rental Agreement:
- Equipment must only be used in accordance with manufacturer guidelines and weight limits.
- Sub-leasing, unauthorized modification, or taking equipment outside Bali without express written authorization is strictly prohibited.
- Customers are responsible for exercising ordinary diligence and safekeeping while equipment is in their custody.
5. Pricing, Currency & Payment Terms
All official rental rates are denominated in Indonesian Rupiah (IDR). Any foreign currency estimates displayed on the Platform are provided solely for informational reference. In compliance with Bank Indonesia regulations (PBI No. 17/3/PBI/2015), transactions executed within Indonesia are billed in IDR.
Accepted payment methods include major credit/debit cards, Indonesian QRIS, electronic bank transfers, and Cash on Delivery (COD) upon courier delivery at your hotel or villa.
6. Intellectual Property Rights
All trademarks, logos, content, text, photographic assets, and software comprising the Platform are the exclusive property of PT Medisfera Farmasi Group or its licensors. No content may be copied, reproduced, scraped, or republished without prior written permission.
7. Limitation of Liability
To the maximum extent permitted under Law of the Republic of Indonesia No. 8 of 1999 on Consumer Protection:
- BaliRent shall not be held liable for indirect, incidental, punitive, or consequential damages resulting from user misuse, reckless operation, or medical complications arising independently of our equipment.
- Our total cumulative liability for proven direct equipment defect claims shall be strictly capped at the total rental fees paid by the customer for the specific affected item.
8. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the substantive laws of the Republic of Indonesia.
Any dispute arising from or related to these Terms shall first be resolved through good-faith deliberations (Musyawarah untuk Mufakat). If an amicable settlement cannot be reached within thirty (30) days, the dispute shall be submitted to the exclusive jurisdiction of the District Court of Denpasar (Pengadilan Negeri Denpasar), Bali.
